1. Acceptance of Terms
By accessing or using ShopAIflex ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all visitors, users, and merchant accounts.
2. Description of Service
ShopAIflex is an AI-powered product discovery platform that aggregates and indexes product listings from Shopify stores. We provide search, comparison, and analytics tools for shoppers and merchants. We do not sell products directly and are not a party to any transaction between shoppers and merchants.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at shopaiflex@gmail.com if you suspect unauthorized access. We reserve the right to terminate accounts that violate these terms.
4. Merchant Accounts
Merchants registering on ShopAIflex represent that they own or have authorization to manage the Shopify store they register. Merchants are responsible for the accuracy of their store information. Merchant dashboard data (impressions, views, click events) is derived from ShopAIflex's tracking infrastructure and is provided for informational purposes only.
5. Acceptable Use
You agree not to: (a) scrape, crawl, or systematically extract data from the Service without written permission; (b) attempt to reverse-engineer, disassemble, or decompile the Service; (c) use the Service for any unlawful purpose; (d) impersonate another person or entity; (e) interfere with or disrupt the integrity or performance of the Service.
6. Intellectual Property
All content on ShopAIflex, including logos, design, and software, is the property of ShopAIflex or its licensors and is protected by copyright and other intellectual property laws. Product listings, images, and descriptions remain the property of their respective merchants and Shopify stores.
7. Analytics and Tracking
With your explicit consent, we track product interaction events (impressions, views, buy-now clicks) to improve search relevance and to provide merchants with aggregated analytics. You may withdraw consent at any time through your account profile. We never share personally identifiable information with merchants unless you have consented.
8. Purchases and Transactions
ShopAIflex does not process payments or handle transactions. When you click "Buy Now", you are redirected to the merchant's Shopify store. Any purchase you make is solely between you and the merchant. We are not responsible for product quality, delivery, returns, or disputes arising from those transactions.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that product listings are accurate, current, or complete. Prices shown may differ from merchant websites due to caching or updates. We are not responsible for any loss arising from reliance on information displayed on the Service.
10. Limitation of Liability
To the fullest extent permitted by law, ShopAIflex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from use of the Service shall not exceed $100 USD.
11. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.
12. Modifications to Terms
We may update these Terms at any time. We will notify registered users of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, merchants, us, or third parties. You may terminate your account at any time by contacting shopaiflex@gmail.com.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. Any disputes shall be resolved exclusively in the courts of Delaware.
